Massachusetts Supreme Court rejects Uber's arbitration agreement

The Massachusetts Supreme Judicial Court ruled that Uber failed to provide users with reasonable notice of the terms and conditions for arbitration clauses, in addition to having failed to obtain a clear manifestation of assent to the terms. Plaintiffs of the case sued Uber alleging that three Uber drivers refused to provide a ride to one of its users because he was blind and was accompanied by a guide dog, which violated the state's antidiscrimination law. In an earlier court ruling, the individual was denied having the case judicially examined because of the arbitration clause. After the Supreme Court decision, the plaintiff will have the right to have his case decided by a judge instead of an arbitrator.
